Alevea Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the website, online services, electronic communications, text messaging services, and other digital services provided by Alevea Mental Health LLC (“Alevea,” “we,” “us,” or “our”).

By accessing our website, submitting information through our website, communicating with us electronically, or opting in to receive text messages from Alevea, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or electronic communication services.

1. About Alevea Mental Health

Alevea Mental Health LLC provides healthcare services that may include psychiatric evaluation and treatment, medication management, counseling or psychotherapy, primary care, wellness services, ADHD assessment, ketamine therapy, and other healthcare services offered by Alevea from time to time.

Availability of specific services may depend on location, provider licensure, clinical appropriateness, insurance coverage, and applicable federal and state law.

Information available through our website is provided for general informational purposes and is not intended to replace evaluation, diagnosis, or treatment by a qualified healthcare professional.

2. Medical Emergencies

Alevea's website, email, text messaging services, online forms, and other electronic communications are not intended for medical emergencies or urgent medical needs.

If you believe you are experiencing a medical or psychiatric emergency, call 911 or go to the nearest emergency department.

Electronic messages may not be reviewed immediately. You should not rely on text messaging, email, website forms, or other electronic communication methods for urgent or time-sensitive medical matters.

3. No Medical Advice Through Website Content

Information provided on Alevea's website, social media accounts, educational materials, blog posts, automated communications, or other general digital content is provided for educational and informational purposes only.

Such information does not establish a clinician-patient relationship and should not be interpreted as individualized medical advice, diagnosis, or treatment.

A clinician-patient relationship is established only through an appropriate professional clinical encounter and in accordance with applicable law.

4. Appointments and Scheduling

Alevea may allow patients and prospective patients to request, schedule, confirm, reschedule, or cancel appointments electronically.

Submitting an appointment request does not guarantee an appointment until the appointment has been confirmed by Alevea.

Patients are responsible for providing accurate contact and scheduling information and for complying with Alevea's applicable appointment cancellation, rescheduling, and no-show policies.

Alevea may modify provider schedules or appointments when clinically or operationally necessary.

5. SMS/Text Messaging Program

Alevea may communicate with patients and prospective patients through SMS or MMS text messaging.

These communications may include:

  • Appointment confirmations

  • Appointment reminders

  • Scheduling and rescheduling communications

  • Registration reminders

  • Patient account notifications

  • Requests to contact our office

  • General administrative communications

  • Prescription or refill-related administrative notifications

  • Billing or payment reminders

  • Follow-up communications

  • Information about services requested by the patient

  • Other healthcare-related communications initiated or authorized by the patient

Text messages should not be used for emergencies or urgent clinical matters.

SMS Consent

By providing your mobile telephone number and affirmatively opting in to receive text messages, you authorize Alevea Mental Health LLC and its service providers, including communication technology vendors such as Weave, to send SMS or MMS messages to the telephone number you provided.

Consent to receive text messages is not a condition of purchasing goods or services or receiving healthcare from Alevea.

You represent that you are the subscriber or customary user of the mobile number you provide or that you otherwise have authority to consent to receiving communications at that number.

Message Frequency

Message frequency varies depending on your appointments, requests, interactions with Alevea, and healthcare needs.

Message and Data Rates

Message and data rates may apply.

Alevea is not responsible for fees charged by your wireless carrier.

Opting Out

You may opt out of receiving text messages at any time by replying:

STOP

After you send STOP, you may receive one final confirmation message indicating that you have been unsubscribed.

You may also contact Alevea directly and request removal from non-essential text communications.

Opting out of text messaging will not prevent Alevea from communicating with you through other permitted methods when necessary for your care or account.

Supported Carriers

Wireless carriers are not liable for delayed or undelivered messages.

Delivery of SMS or MMS messages is subject to effective transmission by your wireless carrier and network provider.

Alevea cannot guarantee that every message will be delivered.

6. Privacy of SMS Communications

Alevea takes reasonable measures to protect patient privacy. However, ordinary SMS and MMS messaging may not always be fully secure or encrypted.

By choosing to communicate with Alevea through text messaging, you acknowledge that electronic communications may involve privacy risks, including access by persons who have access to your mobile device, telephone account, wireless carrier account, or message notifications.

Alevea will attempt to limit sensitive information transmitted through ordinary text messaging when appropriate.

Your personal information will not be sold or shared with third parties for their own independent marketing purposes based on your SMS consent.

Mobile information and SMS consent information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be shared with vendors and service providers only as reasonably necessary to provide communications and other services on behalf of Alevea, subject to applicable privacy and contractual requirements.

SMS opt-in information and consent will not be shared with third parties for unrelated marketing purposes.

7. Protected Health Information

Alevea handles protected health information in accordance with applicable privacy laws, including the Health Insurance Portability and Accountability Act (“HIPAA”), when applicable.

Healthcare privacy practices are governed separately by Alevea's Notice of Privacy Practices.

These Terms do not replace or modify rights provided under HIPAA or other applicable healthcare privacy laws.

8. Privacy Policy

Use of Alevea's website and digital services is also subject to Alevea's Privacy Policy.

The Privacy Policy describes how we collect, use, disclose, and protect information submitted through our website and digital services.

Where applicable, our Notice of Privacy Practices separately describes how protected health information may be used and disclosed in connection with healthcare services.

9. Email and Electronic Communications

By communicating electronically with Alevea, you acknowledge that email and other ordinary electronic communications may have inherent privacy and security limitations.

You are responsible for providing accurate contact information and informing Alevea when your email address, telephone number, mailing address, or other contact information changes.

Alevea may use electronic communications for administrative and healthcare-related purposes as permitted by applicable law and your communication preferences.

10. Telehealth Services

Certain Alevea healthcare services may be provided through telehealth.

Telehealth services are available only when permitted by applicable law and when the treating clinician is appropriately licensed or otherwise authorized to provide care in the jurisdiction where the patient is physically located at the time of the visit.

Patients may be asked to verify their identity, current physical location, contact information, and emergency contact information before or during a telehealth encounter.

Telehealth involves benefits and limitations, including potential technical failures, interruptions, privacy risks, and circumstances in which in-person evaluation may be clinically preferable.

Separate telehealth consent may be required before receiving telehealth services.

11. Prescription Medications

Nothing contained on Alevea's website or in general electronic communications constitutes a promise that a particular medication will be prescribed.

Prescription decisions are made by licensed healthcare professionals based on clinical judgment, medical necessity, applicable standards of care, state and federal law, and the individual circumstances of each patient.

Requests for controlled substances or other medications may require additional evaluation, monitoring, laboratory testing, prescription monitoring database review, or in-person examination.

12. Insurance and Payment

Alevea may participate with certain insurance plans and may also offer self-pay services.

Insurance eligibility verification or benefit information provided by Alevea is not a guarantee of payment by an insurance company.

Patients remain responsible for amounts not paid by their insurer, including applicable deductibles, copayments, coinsurance, non-covered services, or other patient responsibility amounts, subject to applicable law and contractual obligations.

Patients are responsible for providing accurate insurance and billing information.

13. Website Accounts and Forms

You agree that information you submit to Alevea will be accurate and complete to the best of your knowledge.

You should not impersonate another person, intentionally submit false information, attempt unauthorized access to Alevea systems, interfere with website operation, or use our website for unlawful purposes.

If login credentials are provided for any Alevea service, you are responsible for maintaining their confidentiality.

14. Intellectual Property

Unless otherwise indicated, content appearing on Alevea's website—including text, graphics, logos, branding, images, videos, educational materials, page designs, and other content—is owned by Alevea Mental Health LLC or used with permission.

You may view and use website content for personal, noncommercial purposes.

You may not reproduce, distribute, modify, sell, publish, or commercially exploit Alevea content without prior written authorization unless otherwise permitted by law.

15. Third-Party Services and Links

Alevea may use or link to third-party platforms, including scheduling systems, payment processors, patient portals, communication platforms, laboratories, pharmacies, insurance systems, and other healthcare vendors.

Alevea does not control every aspect of third-party websites or services and is not responsible for the independent content, policies, availability, or practices of third parties except as otherwise required by law.

Use of third-party platforms may also be governed by those companies' own terms and privacy policies.

16. Availability of Services

Alevea attempts to maintain reliable access to its website and digital services but does not guarantee uninterrupted availability.

Systems may occasionally be unavailable because of maintenance, internet outages, telecommunications problems, cybersecurity events, vendor outages, technical failures, or other circumstances outside Alevea's reasonable control.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Alevea Mental Health LLC will not be liable for indirect, incidental, consequential, special, or punitive damages arising solely from use or inability to use its website or general digital communication services.

Nothing in these Terms is intended to waive rights that cannot legally be waived or to limit liability where doing so is prohibited by applicable law.

Nothing in this section alters Alevea's professional obligations regarding healthcare services provided to established patients.

18. Prohibited Uses

You may not use Alevea's website or digital communication systems to:

  • Violate applicable law

  • Transmit malicious software

  • Attempt unauthorized system access

  • Harass or threaten Alevea staff, providers, or other persons

  • Submit fraudulent information

  • Interfere with the operation or security of Alevea systems

  • Scrape, copy, or exploit website content without authorization

  • Engage in fraudulent billing, identity theft, or impersonation

Alevea may restrict access to digital services when misuse is suspected.

19. Changes to These Terms

Alevea may update these Terms periodically to reflect changes in our services, technology, legal obligations, or business practices.

The current version will be posted on our website with an updated “Last Updated” date.

Continued use of the website or digital services after changes become effective constitutes acceptance of the updated Terms where permitted by law.

Material changes affecting SMS communications may be communicated through appropriate channels when required.

20. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where federal law or another state's applicable healthcare laws govern a particular matter.

Any legal proceeding relating specifically to these Terms shall be brought in a court of competent jurisdiction in Arizona unless otherwise required by applicable law.
